Terms of Use
AskDarian operates the website at askdarian.com. These Terms of Use govern your access to and use of the site. By using the site, creating an account, or submitting any content, you agree to these Terms. If you do not agree, please do not use the site.
1. Eligibility and accounts
You must be at least 18 years old to create an account or submit a review. If you are under 18, you may only use the site with the involvement and consent of a parent or legal guardian, and a parent or guardian must submit any review on your behalf. The site is not directed to children under 13, and we do not knowingly allow children under 13 to create accounts or submit content.
To submit a review you must sign in and create an account. You are responsible for the accuracy of your account information and for all activity under it. You agree to provide truthful information and not to impersonate anyone or misrepresent your relationship with any coach.
2. Your reviews and responsibilities
You are solely responsible for the reviews, ratings, and other content you submit. By submitting content, you confirm that it reflects your own genuine first-hand experience or honest opinion; that it is truthful and not knowingly false or misleading; that it is not defamatory, harassing, threatening, obscene, hateful, or unlawful; that it does not reveal private personal information about anyone; that it does not infringe anyone's rights; and that you are not posting it in exchange for payment or to unfairly harm a coach's reputation.
Many coaches listed on the site teach minors. Do not include the name, image, or identifying details of any minor in a review. Keep reviews focused on the coaching, not on private matters.
3. Moderation and removal
All reviews are submitted to a moderation queue and do not appear on the site until we approve them. We may, at our sole discretion and without notice, decline to publish, edit for length or clarity, label, or remove any content for any reason. Approval of a review is not an endorsement of its accuracy.
4. For coaches: corrections and removal
If you are a coach or an authorized representative and believe a review about you is false, violates these Terms, or discloses private information, contact us at askdarianhq@gmail.com with the coach name, a link to the review, a description of the concern, and confirmation that you are authorized to act on the coach's behalf. We review good-faith requests and may remove or annotate content at our discretion. We aim to respond within 7 business days.
5. Disclaimer about reviews
Reviews on the site are the personal opinions of the individual users who submit them. They are not statements of fact by AskDarian, are not independently verified by us, and do not represent our views. We do not endorse, recommend, or guarantee any coach, and we make no representation about any coach's qualifications, character, safety record, or fitness for any purpose. You are responsible for your own decisions about whether to engage any coach, including your own due diligence and any background or safety checks.
6. Your content license
You keep ownership of your content. By submitting it, you grant AskDarian a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and distribute that content on and in connection with the site. You can request deletion as described in our Privacy Policy.
7. Acceptable use
You agree not to use the site for any unlawful purpose, submit false or fraudulent reviews, scrape or harvest data, attempt to gain unauthorized access to the site or other accounts, upload malware, or interfere with the operation of the site.
8. Disclaimers and limitation of liability
The site and all content are provided on an as-is and as-available basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. To the fullest extent permitted by law, AskDarian and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, reputation, or goodwill, arising from your use of the site or any review. Our total liability for any claim related to the site will not exceed 100 US dollars.
9. Indemnification
You agree to indemnify and hold harmless AskDarian and its operators from any claims, damages, losses, and expenses, including reasonable legal fees, arising out of your content, your use of the site, or your violation of these Terms or any third-party rights.
10. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Orange County, California, and you consent to their jurisdiction.
